These Terms and Conditions ("Terms") govern your use of the Fred AI Concierge messaging service and related services operated by Focal Real Estate Group ("we," "us," or "our"). By using our services, you agree to be bound by these Terms.

1. Service Description

Fred is an AI-powered concierge service provided by Focal Real Estate Group. Fred provides:

  • Vendor recommendations for home services (plumbing, HVAC, electrical, etc.)
  • Home value estimates and local real estate market information
  • General real estate guidance and resource referrals
  • Connection to your Focal Real Estate Group agent

Fred is an AI assistant and does not replace professional advice. Home value estimates are based on available MLS data and comparable sales — they are not formal appraisals. Vendor recommendations are based on our curated directory and do not constitute endorsements or guarantees of service quality.

2. Eligibility

You must be at least 18 years old to use our services. By using our services, you represent that you are of legal age and have the capacity to enter into these Terms.

3. SMS/Text Messaging Terms

  • By texting our number or opting in through your Focal agent, you consent to receive text messages from Fred.
  • Message frequency varies based on your interactions and inquiries.
  • Message and data rates may apply. Check with your wireless carrier for details.
  • To opt out: Reply STOP to any message. You will receive a confirmation and no further messages.
  • To resume: Reply START to re-subscribe.
  • For help: Reply HELP for assistance or contact us at james@focalregroup.com.
  • Compatible carriers include but are not limited to AT&T, T-Mobile, Verizon, and Sprint. Carrier participation is not guaranteed.

4. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose or in violation of any applicable laws.
  • Send abusive, threatening, or harassing messages through our service.
  • Attempt to reverse-engineer, manipulate, or exploit the AI system.
  • Impersonate another person or misrepresent your identity.
  • Use our services for commercial solicitation or spam.

5. AI Limitations & Disclaimers

  • Fred is an AI assistant. Responses are generated automatically and may occasionally contain errors or inaccuracies.
  • Home value estimates are informational only and should not be relied upon as formal property appraisals.
  • Vendor recommendations are provided as a convenience. Focal Real Estate Group does not guarantee the quality, timeliness, or outcome of any vendor's work.
  • Fred does not provide legal, financial, or tax advice. Consult appropriate professionals for such matters.
  • Real estate market data is based on available MLS records and may not reflect the most current conditions.

6. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our services, you consent to the practices described in the Privacy Policy.

7. Intellectual Property

All content, features, and functionality of our services — including text, graphics, logos, and software — are owned by Focal Real Estate Group and are protected by copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the fullest extent permitted by law, Focal Real Estate Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

  • Inaccurate AI-generated information or recommendations.
  • Actions taken based on vendor recommendations provided by Fred.
  • Service interruptions, delays, or failures in message delivery.
  • Unauthorized access to or alteration of your data.

9. Indemnification

You agree to indemnify and hold harmless Focal Real Estate Group, its agents, employees, and affiliates from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

11. Termination

We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. You may terminate your use of our services at any time by replying STOP to opt out of messaging.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Larimer County, Colorado.
